Ploposaurus Terms of Service

These Terms of Service ("Terms") are an agreement between you and C4 Payments LLC, a Texas limited liability company doing business as C4 SaaS ("C4 SaaS," "we," "us," or "our"), governing your use of the Ploposaurus game (the "Game") on iOS, Android, and the web. By downloading or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.

The Game license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game for your own personal, non-commercial entertainment. You may not copy, modify, reverse-engineer, resell, or exploit the Game or any part of it except as allowed by law.

Purchases and billing

All purchases in the Game are processed by the Apple App Store or Google Play. We never see or store your payment card. Prices are shown to you before you confirm, in your store's currency. Your purchase is also subject to the terms of the store you buy through.

Virtual items and virtual currency

Gold, lives, power-ups, cosmetic items, passes, and all other in-game items and currency are a limited, revocable, non-transferable license to use those items inside the Game. They are not money, have no cash value, and cannot be exchanged for cash or anything of value outside the Game, and they cannot be sold or transferred to another person or account. Unused virtual items are forfeited if you delete your account or if we terminate your account for a violation of these Terms.

Every item sold in the Game is deterministic: you see exactly what you will receive before you pay. We do not sell randomized ("loot box") items, whether for real money or for in-game currency.

Refunds

Refunds are handled by the store you purchased through, under that store's policy:

• Apple App Store: reportaproblem.apple.com
• Google Play: through your Play Store order history

Any goodwill credit we choose to give (for example, after a support issue) is discretionary, is provided as in-game items or currency rather than cash, and does not change your rights under the store's refund policy or applicable law.

Age requirements

You must be at least 13 years old to play the Game. If you are under the age of majority where you live, you may play only if your parent or guardian agrees to these Terms on your behalf.

You must be at least 18 years old, or the age of majority where you live, to make a purchase in the Game. The Game asks for your date of birth the first time you attempt a purchase and disables purchases for anyone who declares an age under 18. By making a purchase, you represent that you meet this age requirement.

Advertising

The Game is supported in part by advertising. Some ads are optional and reward you with in-game items for watching them. How advertising data is handled, and how you can limit ad personalization, is described in our Privacy Policy.

App store terms

The Game is made available through the Apple App Store and Google Play. These Terms are between you and C4 SaaS only: Apple and Google are not parties, are not responsible for the Game or its content, and have no obligation to furnish maintenance or support for it. If the Game fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the Game; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple or Google, are responsible for addressing any claims relating to the Game (including product liability, legal compliance, and consumer protection) and any claim that the Game infringes third-party intellectual property rights. You must comply with the store terms that apply to you and with applicable third-party terms when using the Game. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to the Game and catalog

The Game is a live service. We may add, change, retire, or re-price items, and we may rebalance gameplay, at any time. Rebalancing or retiring an item is a normal part of running a live game, is not a defect, and does not entitle you to a refund of prior purchases, except where a refund is required by law.

We may also retire the Game entirely. If we do, we will give reasonable advance notice in the Game where practicable. Except where a refund is required by law, unused virtual items and currency expire when the Game is retired.

Acceptable use

You agree not to cheat, exploit bugs for unfair advantage, use unauthorized third-party software to modify the Game, attempt to access other players' accounts, or interfere with the Game's operation or security.

Termination

You can stop using the Game at any time and can delete your account in Settings → Account → Delete. We may suspend or terminate your access if you materially violate these Terms, with notice where reasonably practicable. On termination, your license to the Game and to all virtual items ends.

Disclaimers and limitation of liability

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA, PROFITS, OR GOODWILL; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US FOR THE GAME IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (ii) USD $100.

Nothing in these Terms limits or excludes any right you have as a consumer that cannot be limited or excluded under the law of your country or state, including non-excludable warranties and statutory guarantees, and nothing excludes or limits our liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence, where such liability may not be excluded.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except that if you are a consumer resident in a jurisdiction whose law gives you the right to bring claims in your home courts or under your local law, nothing in these Terms removes that right. We will try to resolve any dispute with you informally first; please contact info@c4saas.com before starting formal proceedings.

Other terms

If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent permitted and the rest will remain in full effect. These Terms, together with the Ploposaurus Privacy Policy, are the entire agreement between you and us about the Game. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Sections that by their nature should survive (including Virtual items and virtual currency, Disclaimers and limitation of liability, and Governing law and disputes) survive termination.

Changes to these Terms

We may update these Terms. If a change is material, we will give notice in the Game at least 30 days before it takes effect where practicable. Continuing to play after the effective date means you accept the updated Terms; if you do not agree, stop playing and delete your account in Settings → Account → Delete.
